Article 1 – Definitions

In these terms and conditions, the following definitions apply:

Cooling-off period: the period within which the consumer may exercise the right of withdrawal.

Consumer: the natural person who is not acting in the course of a profession or business and who enters into a distance agreement with the business.

Day: calendar day.

Durable medium: any tool that enables the consumer or business to store information addressed personally to them in a way that allows future consultation and unchanged reproduction, such as email.

Right of withdrawal: the possibility for the consumer to cancel the distance agreement within the cooling-off period.

Model withdrawal form: the withdrawal form provided by the business that the consumer may use to exercise the right of withdrawal.

Business: the natural or legal person offering products and/or services remotely to consumers via the website, in this case Brilsz, acting as an intermediary.

Distance agreement: an agreement concluded between the business and the consumer within an organized system for distance sales, whereby exclusive use is made of one or more techniques for distance communication.

Technique for distance communication: means that can be used to conclude an agreement without the consumer and business being simultaneously present in the same place.

Seller: the third party, whether or not established within the European Union, offering and selling goods to the consumer via the business’s website.

Website: the Brilsz platform, accessible via www.brilsz.nl, including all associated subdomains.

Article 3 – Applicability

These terms and conditions apply to every offer made by the business and to every distance agreement concluded between the business and the consumer.

Prior to concluding the agreement, the text of these terms shall be made available to the consumer. If this is not reasonably possible, the consumer shall be informed where the terms can be inspected and that they will be sent free of charge upon request.

If the agreement is concluded electronically, the terms shall be provided electronically in a way that allows storage on a durable medium.

If specific product or service conditions apply in addition to these terms, Articles 2 and 3 shall apply accordingly. In case of conflicting provisions, the consumer may rely on the provision most favorable to them.

If any provision is void or invalid, the remaining provisions shall remain in force.

Situations not covered by these terms shall be assessed in the spirit of these terms.

Ambiguities shall be interpreted in favor of the consumer.


Article 4 – The Offer

If an offer has a limited validity period or is subject to conditions, this shall be explicitly stated.

Offers are non-binding. The business reserves the right to amend or withdraw offers.

The offer contains a complete and accurate description of the products. Images are a truthful representation, though minor color deviations may occur.

Each offer clearly states:

  • Total price including VAT and shipping costs

  • Possible import VAT or customs duties (for consumer’s account)

  • Method of concluding the agreement

  • Right of withdrawal

  • Payment, delivery, and execution methods

  • Available payment methods

Brilsz offers affordable sunglasses.
Note: Sunglasses are not resistant to water or seawater.


Article 5 – The Agreement

The agreement is concluded when the consumer accepts the offer and meets the stated conditions.

Electronic acceptance shall be confirmed without delay.

Appropriate security measures shall be taken for electronic transactions.

The business may refuse orders within legal limits.

Upon delivery, the consumer receives:

  • Business contact details for complaints

  • Withdrawal information

  • Warranty information

  • Total price details

  • Payment and delivery details

Brilsz acts as an intermediary and is not a party to the sales agreement between consumer and seller.


Article 6 – Right of Withdrawal

The consumer has 14 days to withdraw without giving reasons.

The period starts the day after receipt of the product.

Products must be returned in original condition and packaging.

The consumer must notify withdrawal within 14 days and return within 14 days thereafter.

If withdrawal information was not provided, the period may be extended.


Article 7 – Costs in Case of Withdrawal

Return costs are borne by the consumer.

Refunds shall be made within 14 days after withdrawal, provided the product has been received or proof of return shipment is provided.

Depreciation due to misuse may be charged.


Article 8 – Exclusion of Withdrawal

Withdrawal is excluded for:

  • Custom-made products

  • Personal items

  • Perishable goods

  • Financial market-dependent goods

  • Unsealed media/software

  • Unsealed hygienic products

Exclusions shall be clearly stated.

Used products may be returned if use did not exceed normal inspection.


Article 9 – The Price

Prices shall not be increased during the validity period, except for legal changes.

Prices include VAT unless stated otherwise.

Errors and misprints reserved.


Article 10 – Conformity and Warranty

Products must conform to the agreement.

Legal consumer rights remain unaffected.

Defects must be reported within a reasonable period.

Warranty excludes misuse and improper handling.


Article 11 – Delivery and Execution

Orders shall be handled with care.

Delivery within 30 days unless otherwise agreed.

Delays entitle the consumer to cancel free of charge.

Risk transfers upon delivery.

Import charges outside the EU are borne by the consumer.


Article 12 – Duration Transactions

Consumers may terminate indefinite agreements with one month’s notice.

Fixed-term agreements may be terminated at end of term.

Trial subscriptions end automatically.


Article 13 – Payment

Payment is made immediately upon ordering.

Incorrect payment details must be reported.

The business may charge reasonable costs in case of non-payment.

Brilsz processes payments on behalf of the seller.


Article 14 – Complaints Procedure

Complaints must be submitted via info@brilsz.nl.

Complaints are handled within 14 days.

Unresolved disputes may be submitted via:

Article 15 – Disputes

Dutch law exclusively applies.


Article 16 – Additional Provisions

Additional provisions shall not disadvantage the consumer.
